Iam trying to license a patent from a man who got a letter from a scam shop. They told him that "average licenses are 5%, but our average is 9%"

Any inventor who gets one of these letters and believes it might a well flush that patent down the toilet, because he will always think that people are trying to cheat him.

Every patent or product has its own value, some might be 10% of retail sales (a downloadable computer game that is finished and only needs marketing and sells millions of copies), but most require a lot of hard work and money to get into manufacturing and into the marketplace and the patent is only a small part of the picture. If the invention gives only a slight edge in a cut-throat market it might not be worth even 0.5%.

Absolutely right Wiz. Every patent's value is specifically contingent upon all of the factors you mentioned.

So this guy won't let you license the patent because he's holding out for an unachievable percentage of return?? That's truly sad indeed! There are many licensing operations out there who will tell you that you'll get an unbelievable commission, simply to get you to sign the paperwork. Many times the inventor receives nothing at all because the licensing agency got all, or at least the lions share of their profit up front, and has no interest in actually getting the invention licensed at all.

I know a very large handful of inventors who would jump at even the 0.5% you mentioned, so here's hoping the fellow comes to his senses before you decide to look elsewhere for a patent to license.

On a side note... If you are looking for an inventor who doesn't mind taking a meager percentage shoot me an e-mail, I would be more than happy to oblige you. :)

I invented a mechine for handycap people I first looked up a company called Davison& associates Inc. they told me I have a great idea and they would patent it for me for a fee of $680.00 Ididn't go with this company.however I saw another promotion company on TV.Ifigured this company was a lagitament company so I contacted them about my idea they told me the same thing Davison told me this company is called P.T.I.of america they ripped me off for $ 680.00 to do the reserch on my idea. I THINK this is sad that our goverment leaders can't stop these ripoff companies from stealing our hard erned money and put them out of business .and make them give back the money they stole and put them in prison for there crime.

So what did you get for your $680? Very sorry to hear about it my friend. I'm sure though in the future you will be able to see through these types of scams in your sleep, and to turn many others away from such operations, so perhaps a silver lining in it all.

Don't give up your pursuit however! All is not lost because of the likes of these operations. What really ticks me off about your story in particular is that you mentioned that the machine you had designed was for handicapped people. Now, I don't know what it is however let's just assume that it would be just 1/4 the value to the disabled as was the kidney dialysis machine... Now who is being hurt buy these guys shooting your hopes and dreams out of the water? There are few words to describe what the independent inventor would and should feel about all this.

I went to see one of those idiotic companies before, thankfully, I didn't buy into their b/s.
They had a nice little shelf in the waiting room with all kinds of cool looking knick knacks, and when I looked at the sign in the middle (I almost missed it), there was a very small placard cleverly placed that stated clearly whatever you divulge belongs to anyone that hears it. (that is paraphrased a little)
They should be skinned alive and made to eat their repro orgs while be being butt raped by m. tyson. (

Thank you very much for the kind comments lagunasun, I truly appreciate them. While your solution may seem a bit extreme to some, it would seem more than applicable to anyone who has ever been taken advantage of by people of this caliber. ;)

Inventors are as a general rule, very good hearted people. They are the mothers, fathers, grandmothers and grandfathers, sons and daughters from every walk of life. I have just described, We The People! Not a demographic which deserves to be scammed in my opinion.

We, the independent inventors of the world must unite to inform ourselves and fight against people and companies that would seek to destroy us such as these invention development firms.

Thanks again, and keep fighting! We can and will prevail.

Are they really scams? If you read the agreements, it says they will do exactly what you got...nothing of real value. Buyer beware! If you know the questions to ask you won't get taken. There are legitimate marketing companies who have expertise in marketing new products and licensing. You will not get by paying $600 or $1000 for a legitimate marketing service. You get what you pay for and it is your responsibility to educate yourself before going forward. Visit www.uiausa.org, www.inventored.org, www.uspto.gov and www.biz-consult.com before you sign any agreements.

You are certainly correct about the actual wording of the agreements which are "offered" by these places, as legally they must be truthful to the greatest extent. The problem with that is, most people aren't familiar enough with legalese to realize what they are getting in an agreement is not at all what was offered in the advertisement or speech from a sales person. So yes, in my opinion that's a scam and the FTC wouldn't have pursued these invention development firms if it wasn't both needed and lucrative to do so. Draw your own conclusions about the implied character of the FTC from that statement...

You are also very correct that there are many legitimate marketing firms, and they don't work for $600-$1000 to do anything of significance. The Invention Development industry however is not targeting "sales", rather thefts, in those amounts either. I have numerous personal accounts from people who have been taken for between $13,000 and $40,000. Now that's a lot of money for nothing!

Although they do not promise in written agreements the same "One Stop Shop" mantra they give out in advertisements and through sales people, they do promise the world and provide absolutely nothing in return. I take that back, you may get back some glossy paper with nifty stuff on it, but that's hardly worth the time and money you spent. That's still the old "bait and switch" at the very least.

Companies like Davidson, Invention Submission Corporation, Inventor's Helpline, Invent-Tech, Advent, Patent and Trademark Institute etc. etc., mark my words, your days in the game are numbered.

ATTN: ALL WHO HAVE BEEN TAKEN BY DAVISON DESIGN AND DEVELOPMENT.

Please call the local FBI office in Pittsburgh, PA. 412-432-4000. Davison Design may have violated Federal Telemarketing Laws (especially concerning Seniors) and laws involving the 1999 Inventor's Protection Act. Please check at www.ripoffreport.com and search Davison. They are currently trying to mitigate the 26M federal fine ordered by Judge Lancaster this summer. They have the fine delayed at this time because they are trying get it reduced by taking it to a higher court. If the FBI receives numerous complaint calls it will get their attention and they will investigate. Also, contact Mr. Jim Parsons at WTAE. He has ran several stories about Davison and there are several inventors attempting to get him to run a follow up story on Davison's operation. I have spent over 13k with Davison and they offered me 6500 to settle - this in unacceptable and they are using www.ripoffreport.com as an arbitrator. I have had it... I contacted Davidson and after seeing their numbers, something like 8 products marketed out of something like 200,000 and they couldn't (or wouldn't) tell me if the inventors made more money then they spent, I decided not to use them. Now I can't get them to leave me alone, even after I unsubscribed! In the early nineties I tried a company called IMPAC. After a year of checking them out, I sent them a check for $6000.00, a month later they filed bankruptcy! I got a check from the court for $34.34. I learned the hard way.

That IMPAC story sounds unfortunately all too familiar Michael. As for Davison... they are hard to get rid of.

The only answer I have found to work with their constant harassment is to claim utter and abject poverty. Something to the effect of, "I have 5 kids, I'm out of work, my credit is terrible and I have no family which is capable of loaning me money." Once they figure that they are going to spend more on time and phone calls to you then they will ever see from you, they usually give up in rather short order.

I hope that helps if you haven't been able to rid yourself of them by this point. Good luck keeping the wolves off your doorstep!

You guys are so funny beause you want everything for nothing. How much does it cost to hire a patent attorney,5000,10000, or 15,000 dollars. What about marketing and Promotion and oh lets not forget to wipe your butts with the fact that only3% of inventors actually make a working prototype thats ready to be marketing. Not the duck tape and rubberband effect you were looking for. So let me see if i had to waste money on a 100/1 shot i dont think id want an attorny handling my invention, what does an attorney know about marketing?
LAst time i check they claimed to be the Jack of all trades and the master of none. YOu guys are pathetic crying about spending money. Well here some advice stop messing around in the fricken basement pay attention to your lives and your money, and invest on the market not your idea. Because based of the facts you have less than 3% of getting your invention in front of descision makers. When was the last time you saw Bill Gates looking for an idea at a Tradeshow. Come one the chief technology officers are focused more on ti9me restrictions, financial deadlines and an atonomy of Paper chasers to stop what truly would be a great idea and spend it on your self.

Here is the truth , The patent lawyers wants your business theats why the spend time and money trying to create these watch dawg websites and stuff. truth be told. Its hard as hell but the world has not been promised to anyone. The fact is that i have never seen anyone state that they went thru a patent lawyer and after spending how much? 5-10 thousand dollars the were as success. I laugh how a fun it is to read all these letters about how people got ripped off. When lawyers charge you 250 dollars for a consultation on your rights that are free on USPTO.COM HOWHONEST ARE THEY? I know our goverment wouldnt try to harm its citizens right? yeah ok why does a attorney charge you 500-1000 for a patent search thats cost 10$. How come an attorney knows that technical drawings and schematics have to be drafted by an engineer at best to really have detailed outline of your idea for the patent office? Folks in this blog are mentioning Davidson...
This weekend, one of my relatives was telling me about this company named Davidson. I'm not sure if it's the same one or not. It was Davidson (invent....something???).
They spent $6,000 already and are told everything will be marketed for them. In the end, they will spend another $6k. They are told everything is being done for them. My relatives are pretty pleased so far as these folks from Davidson are calling them daily on "updates on the production" of the product.

I have a couple inventions patented myself. I used a regular patent attorney and i know how much work it was and how much it costs.

Do you folks believe these Davidson people are taking advantage of my relatives? If so, any ideas how i should approach it with them. They are on cloud 9 right now. :-) so, i don't know if they'd listen to me. That being said, i wouldn't want them to waste any more money if this is a sham.......

Well, after dealing with one of these invention companies (Davison) several years ago, I was $800 in. They came back and stated that they had a company interested in pursuing my idea, but now it was going to be another $10K to build a working model....... BS. I told them they could take a higher cut off the end if someone was really that interested. They said they couldn't do it, and I was unable and unwilling to pay that kind of cash. Well, to my surprise I was on an airplane yesterday flying home and picked up the sales magazine they have in the seat. I literally nearly threw up when I saw MY INVENTION in this magazine! I am now looking for the paperwork that I had kept from this and will be contacting a lawyer. These guys are scumbags and it looks like they may be thieves as well.
